These Terms & Conditions ("Terms") govern your use of this website and the flat-fee Legal Strategy Document service described on the practice pages on this site. By using the site or purchasing the service, you agree to these Terms. If you do not agree, do not use the site or the service.

1. Who provides the service

The service is provided by Janine Swart, an Admitted Attorney of the High Court of South Africa. References to "I", "me", or "my" in marketing copy on this site refer to Janine Swart in that capacity. These Terms form a contract between you and Janine Swart for the scope described below.

2. Nature of the Legal Strategy Document

The Legal Strategy Document is a limited-scope, written product based on the facts and documents you supply. It is designed to give you a structured assessment and practical next steps in the type of matter you selected on this site (for example disputes involving contracts, notices, compliance, or court/tribunal-facing documentation).

It is not:

  • full legal representation;
  • appearance at a tribunal, bargaining council, or court;
  • ongoing retainer-based advice unless separately agreed in writing;
  • a guarantee of any particular outcome.

No attorney–client relationship beyond the agreed written product arises except as expressly set out in these Terms and any separate written mandate you may sign later.

3. Eligibility and your responsibilities

You warrant that:

  • the information you provide is accurate to the best of your knowledge;
  • you have the right to share any documents you upload;
  • you will not use the service for any unlawful purpose.

You remain responsible for meeting any time limits or procedural steps in your matter. The written strategy is guidance only; you decide whether and how to act on it.

4. Fee, payment, and document limits

The advertised fee (currently R500) is a once-off flat fee for the service as described on the site and at checkout. Payment is processed through a secure payment gateway. Prices may change for future purchases; the fee that applies is the one confirmed at checkout.

Unless otherwise stated at checkout, the service includes review of a limited volume of documentation (as described in the FAQ). If your matter requires review beyond that scope, I may offer a custom quote or decline the matter and refund where appropriate (see section 6).

5. Delivery and communication

After payment confirmation and receipt of your intake information, I aim to deliver your Legal Strategy Document by email within 2 to 3 business days, excluding weekends and South African public holidays. This is an estimate, not a guarantee; complex matters or high volume may require more time, in which case I will notify you.

The service includes a one-time email clarification on the recommendations in your document, as described on the site. It does not include review of new facts or separate legal issues unless a new mandate is agreed.

6. Refunds and cancellation

If I cannot provide the service (for example due to conflict of interest, scope mismatch, or volume beyond the flat-fee model), I will explain this and, where appropriate, offer a full refund of the fee paid for that request. Where work has already been substantially completed, a partial refund may apply instead, in line with fair practice.

Statutory rights under the Consumer Protection Act 68 of 2008 may also apply to electronic transactions. Nothing in these Terms limits rights you cannot lawfully waive.

7. Limitation of liability

To the fullest extent permitted by law, I am not liable for any indirect, consequential, or punitive loss, or for loss of profit or opportunity, arising from your use of this site or the written product. My total liability for any claim relating to a single purchase is limited to the fee you paid for that purchase, except where the law does not allow such a cap.

The document is based on the information you supply. I am not responsible for outcomes at tribunals, courts, third parties, or elsewhere.

8. Intellectual property

Website content and the structure of materials delivered to you are protected by copyright. You may use your Legal Strategy Document for your personal use in your own matter. You may not resell, publish, or systematically redistribute it without written consent.

9. Privacy and cookies

Personal data is processed as described in the Privacy Policy and Cookie Policy.

10. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. You consent to the jurisdiction of South African courts for disputes, subject to any mandatory consumer protections.

11. Changes

I may update these Terms from time to time. The version on this page with an updated date applies to new purchases. Continued use of the site after changes constitutes acceptance of the updated Terms for future interactions.
