Janine Swart ("I", "me") respects your privacy. This Privacy Policy explains how I collect, use, store, and protect personal information when you use this website and the Legal Strategy Document service, in line with the Protection of Personal Information Act 4 of 2013 ("POPIA") and related laws.
1. Responsible party
The responsible party for personal information processed through this site and the flat-fee service is Janine Swart, practising attorney. Contact for privacy queries should be made using the same channels as for client correspondence—for example the email address provided after you instruct me, or the contact details published for this practice.
2. What information I collect
Depending on how you use the site, this may include:
- Identity and contact data: name, email address, phone number, and similar fields you enter on forms.
- Matter-related data: descriptions of your situation, documents you upload, and other information needed to assess conflicts and prepare the Legal Strategy Document.
- Technical data: IP address, browser type, device information, and similar data collected via cookies or server logs where applicable (see the Cookie Policy).
- Payment metadata: payment confirmations processed by the payment provider; I do not store your full card details on this site.
3. How I use your information
I process personal information only for lawful purposes, including to:
- provide the Legal Strategy Document and related communications;
- perform conflict checks and scope assessment;
- process payments and comply with accounting or tax obligations;
- improve website security and functionality;
- comply with legal or regulatory duties applicable to attorneys.
I do not sell your personal information. I do not use it for unrelated direct marketing unless you have opted in where the law requires consent.
4. Legal basis (POPIA)
Processing is based on your consent where you submit forms or optional cookies, on contract where necessary to deliver the service you purchase, on legitimate interests (such as securing the site and record-keeping), and on legal obligation where the law requires retention or disclosure.
5. Sharing and processors
I may share information with:
- Service providers who host the site, send email, or process payments, under agreements that require appropriate safeguards;
- Professional advisers where required (for example auditors), bound by confidentiality;
- Authorities where the law compels disclosure.
I do not contact opposing parties or third parties as part of the standard Legal Strategy Document service unless you separately instruct representation that expressly includes that step.
6. Cross-border transfers
Your data is primarily processed in South Africa. If any processor stores data outside South Africa, I take steps to ensure an adequate level of protection as required by POPIA.
7. Retention
I retain records for as long as needed to provide the service, meet legal and regulatory retention rules for attorneys, and defend potential claims. When retention periods end, I delete or anonymise information where practicable.
8. Security
I implement reasonable technical and organisational measures to protect personal information. No online transmission is completely risk-free; you should also protect your devices and passwords.
9. Your rights
Under POPIA you may have the right to:
- request access to personal information I hold about you;
- request correction or deletion where conditions are met;
- object to certain processing;
- lodge a complaint with the Information Regulator (South Africa).

10. Children
This site and service are intended for adults. I do not knowingly collect personal information from children without appropriate authority.
11. Changes
This Privacy Policy may be updated. Material changes will be reflected by the "Last updated" date at the top of this page.
